"Mr President, the Council considers the protection of fundamental rights to be very important. As Article 6 of the Treaty on European Union states, the Union is based on the principles of freedom and democracy, the respect for fundamental rights and fundamental freedoms, and the rule of law. The same Article states that the Union respects fundamental rights as a general principle of Community law. With the Treaty of Amsterdam becoming effective on May 1 this year, the new Article 13 of the EU Treaty gives the Council the power, within the limits of power the Community is entrusted with under the Treaty, to take action to combat any form of discrimination
discrimination based on sexual orientation without, however, limiting the application of other provisions in the Treaty.
The provisions require a proposal from the Commission and a hearing in the European Parliament, for the Council to take a legal decision. The Council has to say that, thus far, there has been no such proposal from the Commission that is based on the new Article 13 referred to. The Council would remind everyone, for the sake of clarity, that it is the exclusive authority of the Member States to prevent the attacks and attempts on people’s lives the honourable Member refers to. They alone are responsible for maintaining order and protecting people and property."@en1
